One week after the dismissal of Ms. Jitra, the president of Triumph International Labour Union Thailand, workers were able to negotiate with the regional representative of Triumph International Limited in a tripartite meeting. However, this meeting on August 9 had made little progress. On August 11, the union again called for a strike. About 1000 workers, one third of the company�s labour force, blocked the entrance of the factory. Hundreds of workers blocked the industrial zone intersection. They demanded Body Fashion, Triumph International�s manufacturing arm, reinstate union president Ms. Jitra Kotchadej, refrain from taking legal and disciplinary action against striking workers and remove company executives who tried to disrupt union activities. Facing the continuous strike, the company threatened the workers that they would fire all current workers and start new recruitment.

Tell Chinese Officials: Release Innocent Workers, Bring Corrupt Owner to
Justice

On February 13, the seventh day of the Chinese New Year, some 700 workers
at the Panyu Li Chang Footwear Co. Ltd in Panyu district of Guangzhou City
returned from their New Year holiday. They were expecting to receive
their back wages ? estimated to be around 2,000 Yuan per worker ? and
resume work. Instead, they found that the owner had stolen their wages,
closed the factory and sold all the equipment. The gates to the factory
and their living quarters were locked. Dozens of long-term workers
discovered that the owner had not paid their social insurance and other
entitlements for around ten years. Others found that payments had not
been made for the last nine months despite being deducted from their
monthly wages.

In an attempt to seek justice, approximately 400 workers peacefully walked
from the factory to the Guangzhou Municipal government offices. The
police stopped the workers and detained about 50 of them. Five were
formally arrested and detained on criminal charges for illegal assembly
and demonstration.

Please take action today to demand the immediate and unconditional release
of the five workers who spontaneously and peacefully walked with their
fellow workers to report the factory owner?s crime and call on the
authorities for help.

According to the report in the Panyu Daily, on February 28 the five
workers were forced to stand on a podium while their arrests were publicly
announced. Jian Xi Bo, the district standing committee and secretary of
the politics and law committee, was reported to have said that workers who
use road or bridge blockades to express their discontent will not be
protected by law. The walk to the government offices, however, was both
spontaneous and peaceful. The workers should not be penalized for
blocking traffic since this was the inevitable consequence of the fact
that so many workers were robbed and evicted by the factory owner in one
day.

It is time for China to stop its systematic repression of internationally
recognized human rights, particularly freedom of expression and freedom of
association. The ability of workers to engage in dialogue with employers
and openly express their grievances is a fundamental part of a just
society.

RELEASE HUMAN RIGHT DEFENDERS, STOP HARASSMENT ON THEIR FAMILIES - CHINA

SUMMARY



The Justice and Peace Commission of Hong Kong Catholic Diocese (HKJP) is highly concerned with the continuous arrests of human rights defenders in China. Together with China Human Rights Lawyers Concern Group, the Commission has initiated a campaign for 3 high profile human rights defenders: Hu Jia, Guo Feixiong (aka Yang Maodong) and Chen Guangcheng. The Commission plans to channel support letters / signatures to the Chinese authorities through Liaison Office of the Central People� s Government in Hong Kong in early February. It is hoped that aggregated effort can press for human rights defenders� release before the Chinese New Year in early February 2008, so the 3 can spend the important festival with families.



It is common for human rights defenders (HRDs) in China to experience arbitrary detention / arrest, unfair hearing, torture and inadequate medical treatment. Many of them are reported to be in dire health condition. Since his arrest on 27 December 2007, Mr. Hu Jia, a renowned HIV/AIDS activist was denied access to family and lawyers. Medication from his wife was rejected and it is not clear if daily access to the medical treatment he needs for his liver disease is guaranteed and if he can count on a doctor�s assistance during his detention. On the other hand, Mr. Guo Feixiong has been beaten in prison and has started hunger strike since 13 December 2007. He was reportedly locked on a wooden bed for 42 days and given electric shocks on his genitals during his 14 months detention from September 2006 to November 2007.



Often, HRDs� families and lawyers experience different levels of harassment. Ms. Zeng Jinyan, wife of Mr. Hu Jia was put under residential surveillance as soon as her husband was arrested in December 2007. The couple�s friends, lawyers and reporters have been barred from contacting her. The passport and telephone of Ms. Yuan Weijing, wife of the blind activist Mr. Chen Guangcheng, were confiscated by Chinese authorities on her attempt to pass the security cordon at the Beijing airport to fly to the Philippines to receive the Ramon Magsaysay Award for emergent leadership.

We are gravely concerned with the alleged torture and injustice to human rights defenders, Hu Jia, Guo Feixiong (aka Yang Maodong) and Chen Guangcheng. They are detained in the Beijing Municipal Detention Centre at Dougezhuang in Chaoyang District, Meizhou Prison of Guangdong Province and Linyi City Prison of Shangdong Province, respectively. Their families and lawyers were reportedly harassed by the police. As the important festival of Lunar New Year is approaching, we sincerely request your kind attention to bring peace to them and their families.



We appreciate the Chinese authorities� promise upon being awarded to host the 2008 Olympic Games in July 2001: Wang Wei, the Secretary General of the Beijing Olympics Organizing Committee confirmed that "the Games...not only promote our economy but also enhance all social conditions, including education, health, and human rights." Similar pledge was made by your government when signing International Covenant on Civil and Political Rights (ICCPR) in 1989. Articles 7, 9(1) and 14(1) state "no one shall be subjected to torture or cruel treatment"; "no one shall be subjected to arbitrary arrest or detention" and" all persons shall be entitled to a fair and public hearing". It is also unfortunate to see the continuous harassment that infringes Article 17 of ICCPR which states that �no one shall be subjected to arbitrary or unlawful interference with his privacy, family, home or correspondence.�



With sincere faith that the authorities exercise utmost effort to improve human rights condition as part of the effort for Beijing Olympic Games, we kindly request your honour to:

BACKGROUND

Hu Jia, the latest victim

Mr. Hu Jia, a Beijing-based HIV/AIDS activist, is the co-founder and former director of the Beijing Aizhixing Institute for Health Education, a grassroots organization that aims at educating the public about HIV/AIDS and at advocating for the rights of persons suffering from AIDS. In early Dec �07, Hu Jia and his wife, Ms. Zeng Jinyan received a special press freedom award from Reporters without Borders. He was also nominated for the Sakharov Human Rights Award of the European Parliament. There is immense international pressure demanding his release, including a resolution passed by the European Parliament on 17 Jan �08.

On 27 Dec �07, about 20 policemen came to Mr. Hu Jia�s home, surrounded his wife and child as well as his wife�s grandmother, who was visiting, cut off the telephone line and internet connection, confiscated their mobile phones and then took Hu away, on suspicion of �inciting subversion of state power�.

Prior to this, he has been victim of constant harassments due to his human rights activities:

� 7 Sep �06: arrested by 20 plain-clothes policemen and detained for 12 hours for no official reason.

� 26 Sep �06: taken to the local public security bureau and was interrogated on his relationship with 2 other human rights lawyers, Mr. Gao Zhisheng and Mr. Chen Guangcheng, as Mr. Hu Jia had started an Internet campaign for their defence.

� 16 Feb to 28 Mar �06: allegedly �detained� for having participated in a hunger strike organized by human rights defenders and lawyers. During his �disappearance�, authorities denied him the right to have access to the medication he requires to treat Hepatitis B.

� Apr to 27 Dec �07: put under residential surveillance.

Since his latest arrest, policemen remained at their home, preventing Ms. Zeng Jinyan from publicly denouncing his detention. Mr. Li Jinsong, lawyer of Ms. Zeng was also reportedly detained by the police at his hotel in Beijing on 11 Jan �08, when reporters from international news agencies have been invited to cover lawyers� effort to visit Ms. Zeng.



Guo Feixiong (aka Yang Maodong), victim of unfair trial and torture

Guo Feixiong was sentenced to 5 years imprisonment on 14 Nov �07 for conducting illegal business activities, after publishing �Shenyang Political Earthquake� a book exposing government corruption in Shenyang City, Liaoning Province. It is alleged that his sentence is related to the legal assistance he had provided since July �05 to the peasants of the village of Taishu, Guangdong Province, in an attempt to dismiss the head of the village committee, who was suspected of corruption.

His family is very concerned about his current health condition. After a visit on 28 Dec �07, Guo�s wife, Ms. Zhang Qing told the press that her husband is suffering from irregular heartbeat and looked emaciated. "He was beaten on 18 Dec �07 by a fellow prisoner, the fifth day after he entered the prison in Meizhou� (The authorities) also threatened to send him to a mental hospital. In the past they carried out their threat to send him to Shenyang, where he was tortured." Guo has started a 100-day hunger strike since 13 Dec �07.

During the 14 months of investigation, Guo was reported to experience inhumane treatment and unfair trial. In his wife�s statement dated 28 Dec �07, Guo mentioned that the people who interrogated him on 12 Feb �07 were not the same as those who appear on the interrogation records which were provided by the prosecutors during the hearing. He thus believes those records are perjurous. He also said that his attempted suicide on 13 Feb �07, following the confession extorted through the use of electric shocks on his genitals on 12 Feb �07, had also been recorded by video as evidence. However, the video was not presented in the hearing. During a prison visit on 11 Jan �07, Guo told his lawyer that he had been handcuffed and shackled to his bed for more than 40 days. He was also deprived of sleep for days and subjected to around-the-clock interrogation.

Chen Guangcheng � continuous harassment on his family

Chen was sentenced to 4 years and 3 months for "damaging property and organising a mob to disturb traffic" on 24 Aug �06. His lawyer and wife say the charge was trumped up by local officials angered by his blistering exposure of abuses by local family planning officials under China�s one-child policy. He was earlier addressed by the Time Magazine as one of the 100 most influential people in shaping our world in April �06.

According to the information received, on 16 June �07, some guards of the Liyni City Prison (Shandong Province) obliged 6 prisoners to beat Mr. Chen Guangcheng after he refused to have his head shaved. When Chen�s wife visited him on 19 June �07, he told her that he had pains in his ribs and that he feared to have a broken rib. His wife, Ms. Yuan Weijing, protested to the guards about the mistreatment and demanded that the prison immediately arrange for Mr. Chen to be sent to a hospital for a check-up, including an x-ray of his ribs, which the authorities refused.

Chen�s wife, Ms. Yuan Weijing has been under survillance since August 2005. The latest one took place on 8 Jan 2008: it was alleged that the authorities have tapped the phone line and learnt that a German television journalist wanted to visit Ms. Yuan and Chen�s elder brother, Mr. Chen Guangfu. Officials then blocked all the roads leading to Yuan�s village, increased the number of police watching her house to 40 and threathened to arrest Chen Guangfu. The interview failed to happen ultimately.

Currently, the political decision-makers in Government and Knesset are discussing the future of the Plan � which for us means: our future � and almost every day, different stories reach us on the news or in the Wisconsin centres: the Wisconsin Plan will be extended � the Wisconsin Plan will be amended � the Wisconsin Plan will be abolished � the Wisconsin Plan remains as it is� For us, the Wisconsin Plan participants from Nazareth, there is only one sustainable solution: the Wisconsin Plan must be abolished!

On August 17 Goodyear Thailand Ltd. fired union activist Anan Pol-ung in an effort to silence the union. During the last two years Anan has been fighting for the rights of the short term contract workers in the factory. The official reason for dismissing him is that he gave �misleading information� about a visit to his mother who was in the hospital. But when dismissing him, the local management at the 1000-worker factory made it clear that the real reason was his union activities.

When South Korea joined the Organization of Economic and Commercial Development (OECD) in 1996, there was much hoopla and expectations. To the international community it appeared that South Korea was o­n the brink of shedding is shameful image of dictatorship that undermined democracy and fundamental trade union rights. At the time, South Korea had agreed that it would amend its existing labour legislation in line with existing international labour standards and OECD guidelines. However, ten years later, South Korea has still a long way to go. The recent repressive actions of the South Korean government under the Roh Moon Hyun administration clearly shows that South Korea has failed as an economically developed democratic country in ensuring fundamental trade union rights according to international labour standards.

In March of this year, the Governing Body of the ILO approved the interim report made by the Committee o­n Freedom of Association. Apparently, the South Korea case was the longest of outstanding case within the CFA aside from o­ne filed against Columbia. The recommendations raised serious concerns o­n the government�s repressions against trade unions, specifically the Korean Government Employees Union (KGEU) and the Korean Federation of Construction Industry Trade Unions (KFCITU). However, the government not o­nly has refused to implement these recommendations but more importantly it has chosen to intensify its attacks o­n the KGEU and the KFCITU, thus, snubbing its �nose� to international labour standards.

What the union members of the KGEU Gyeongnam Jinju Chapter, which had protected the union office from the attacks by the riot police and the authority, faced in the morning of September 28 were much more riot policemen packed up around the building and a ladder truck outside. At 06:10, the union members and solidarity organisations members who held a protest sit-in overnight were forcefully pulled out o­ne by o­ne. Till 07:00, the union office was taken over by the riot police and authority.The same happened to the KGEU Gyeonggi Siheung Chapter and Gwangmyeong Chapter. From the dawn of September 28, the attacks started. It didn�t take more than an hour. 2 members from the KGEU Gwangmyeong Chapter were hospitalised. At the same time, the KGEU RDA Chapter was also being attacked. The RDA (Rural Development Administration) is a research institute under the Ministry of Agriculture and Forestry. After the directive o­n March 22 by the Ministry of Government Administration and Home Affairs was issued, the new administrator had broken agreements with the union and refused any negotiations. A peaceful protest rally by the KGEU o­n May 25 in front of the RDA had been attacked by the riot police and hundreds of the union members had been arrested. o­n September 8, the 7 leaders of the KGEU RDA Chapter were dismissed.

The KGEU held a mass rally o­n September 9th in Changwon, Gyeongnam-do (province, south western part of Korea), where the KGEU Gyeongnam Regional Branch office were forcefully closed down o­n August 30, while the ILO Asian Regional Meeting was held in Busan, Korea.The Ministry of Government Administration and Home Affairs (MOGAHA) claimed that the rally was illegal activities and that all the government employees participating would be taken to disciplines. Despite that the rally was legally notified to the police in advance, the MOGAHA insisted that government employees' participating was illegal and that should be blocked.

PSI is requesting its affiliates to send letters of protest to the government of South Korea to register their serious concern about the deterioration of the situation of trade union rights for public sector workers and the increase in repression by the Korean Government against PSI's affiliate, the Korean Government Employees Union (KGEU). Despite repeated recommendations and protests from the international community to stop repression and to guarantee government employees' trade union rights, the Korean government has constantly proceeded with actions aimed at destroying the KGEU. Greetings!

I would like to inform you that INTERNATIONAL APPAREL (Pvt) Ltd. situated in Kot Lakhpat area Lahore, Pakistan manufacturing garments, exporting to America, UK and other European countries, have employed 200 women workers and 50 male workers.

The workers tried to form union under the Industrial Relation Ordinance (IRO) with the assistance of All Pakistan Trade Union Federation. The employer locked out the factory and turned out all the workers from the factory without giving any written notice. The owner has not paid salary from December 2005 to March 2006. Workers held a meeting in the federation office and decided to approach the court of law for payment of wages. So now the management, instead of paying the dues of workers, is harassing their families and compelling them to withdraw the cases from the court. They are threatening to abduct women workers. Due to this, the poor workers are very frightened and are not living in their houses but living with their relatives.

Publicis Thailand, the Thai subsidiary of French-based global public relations giant Publicis Groupe (with revenues of �3.83 billion in 2004) has charged Junya Lek Yimprasert, coordinator of the Thai Labour Campaign (TLC), with "defamation by propagation." Yimprasert's "crime" was republishing an article from CSR Asia Weekly o­n the TLC website about an unfair dismissal case filed by five workers against the public relations company. If convicted Yimprasert faces a possible jail sentence, payment of monetary damages, and limitations o­n her/TLC's important labor rights work. Your action is needed today to help get Publicis to drop this lawsuit.

I would like to inform you about the violation of Cambodia Labor law and the freedom of trade union rights in the Flying dragon III factory. Following are the facts:

From 1997 to 2004 around 2000 workers have been working for the Flying dragon III factory, with time unlimited contracts. In September 2005, three trade union leaders, the president, the vice president and the secretary general were dismissed by the employer of Flying dragon III factory. After dismissing leaders of the local union, a membership organization of the central organization C.CAWDU ( Coalition of Cambodian Apparel Workers Democratic Union), the employer cheated the workers by changing the labour contract from unlimited duration contract to fixed duration contract, mostly two or three-month contracts. With this contract, around 2000 of workers in the factory lost a lot of benefits, for example annual leave and attendance bonus (5 USD per month).

From 22-25 of February, the Filipino people celebrated the anniversary of the "EDSA People Power" in the Philippines which ousted the dictator Ferdinand Marcos 20 years ago. Thousands of people were o­n the streets o­n these days, living the spirit of the EDSA as they marched and called for the stepping down of yet another growing authoritarian president Gloria Macapagal-Arroyo.

In defiance of the spirit of power to the people and democracy itself, Gloria Macapagal-Arroyo declared the Philippines in "the state of emergency" with Proclamation 1017, citing a "clear and present danger" posed by the alliance between forces from the extreme left and the military. This proclamation has been challenged by members of the Philippine Senate and declared as unconstitutional by various groups of lawyers. Leaders of progressive groups and party-list members were arrested, in addition to the list of demonstrators who were picked up and detained from the various big protest actions. o­ngoing crackdown o­n people�s organisations and progressive NGOs are taking place, coming out with a list of people to be arrested for "acts of sedition." Military officials alleged to be involved in the plot to stage a coup de tat have been arrested. Demonstrations, led by progressive groups from the people�s movement, supported and joined in by thousands of ordinary citizens, have been violently dispersed; all permits for demonstrations have been revoked. A national newspaper has been raided and taken over "because it was a possible source of destabilization materials." A warning has been issued that "the police will take over news groups that will not conform to standards set by the government."

This act of desperation of Arroyo to suppress the growing movement calling for her to step down shows that it is her administration which is in "the state of emergency."

His kidneys have been damaged due to excessive bleeding and he can hardly eat and digest any food. And yet defiance still sparkles in the eyes of Bant Singh, a Dalit agricultural labour activist, as he lies in the trauma ward of a state-run hospital in Chandigarh where doctors are battling to save his o­nly remaining leg and even his life.

The freedom of association for workers in Indonesia has o­nce again been violated. PT.Sinar Apparel International has violated ILO Convention Number 87 and ILO Convention Number 98. PT.Sinar Apparel International produces for prominent garment brands such as Marks&Spencer, GAP, John Apparel. The management has retrenched trade union leader, Arifin (a.k.a. Emon). The company reported against him to the police. He has been blamed for taking photos inside the factory. This is a common among workers and there has been no punishment for this act before. It is clear that the company was just searching for some excuse to terminate him.

Hunger Strike Launched by the WTO Political Prisoners

Twelve of the 14 WTO Political Prisoners have decided to launch an indefinite hunger strike starting January 5 to not o­nly highlight the injustice of their case, but more importantly highlight the reason for them coming to Hong Kong---to protest against the WTO. Their fight was not with the people of Hong Kong, but with the undemocratic institution of the WTO and the free trade policies implemented by the WTO without any real consultation with workers and farmers.

Call for Action

We are calling for the international community to express your outrage to the Hong Kong government and the Hong Kong police by calling for the immediate release of the 14 WTO political prisoners. We are asking individuals and organizations to participate in a variety of activities that we are launching in conjunction with the Hunger Strike by the WTO Political Prisoners.

The South Korean government is oppressing the right of the South Korean people's movement to demonstration. This year's APEC Summit will take place in Busan, South Korea, o­n November 18-19. The summit will be attended by the heads of 21 countries including George Bush, Junichiro Koizumi, Vladimir Putin, Hu Jintao, and Roh Moo-hyun. In protest to such a meeting, diverse and numerous organizations of the labour and people's movements including the Korean Confederation of Trade Unions (KCTU), the Korean Peasants' League, and the Democratic Labour Party gathered to form a coalition (People's Action Against the APEC and Bush) and planned to have big demonstration during the meeting. The coalition knows too well that the APEC has been o­ne of the strong supporters of Bush's war and purports to be an effective instrument in the expansion of neo-liberalism. But most important, George Bush is coming to South Korea.

Further to the urgent action petition posted o­n our website, we came to know that o­n October 25, 2005, Ka Ricardo Ramos, president of the Central Azucarera de Tarlac Labour Union (CATLU) was killed by suspected military agents. Soon this was followed by another horrible news: Franciso Rivera, Bayan and Bayan Muna leader in Pampanga, with friends Dr. Angel David, a dentist, and Mr Jon Sabas were sprayed with bullets while jogging o­n October 26. All dead.

Please send your urgent message of condemnation and other actions directed to Gen. Jovito Palparan, the Commanding General in the region, the Cojuangcos and most especially to Gloria Macapagal-Arroyo, the Commander in Chief over all these brutal killings and repression in the Philippines.

It is very crucial that more people are mobilized to take action. This kind of inane killing cannot be tolerated. Let us all hope that our collective action would save the lives of our brothers and sisters in the Philippines.

HSBC-Jakarta is anti-UNION. More than 100 workers were dismissed in 1996, including all unionists, due to their struggle for the betterment. The union has been silent for long time. Era of 'Reformasi' encouraged few workers of HSBC to reactivate the unions by replacing the pro-HSBC leaders. o­ne of prominent organisers, Agus Wahyuni (Vice President of HSBC Union), was dismissed in November 2001. Militant greetings from All Pakistan Trade Union Federation!

I would like to briefly introduce that All Pakistan Trade Union Federation is a National Trade Union Center in Pakistan, having affiliation of 240 trade unions of public and private sector industries and commercial institutions. The informal sector unions, brick kilns workers and general laborers are also part of federation. APTUF is also struggling to eliminate child/bonded labor and all kinds of discrimination against workers (women & men) and striving hard to uplift the working and living condition of down trodden segment of the society.

State of Labor Laws in Country

Workers of Pakistan are facing worst working conditions including long working hours, low wages and no freedom of association. As labor laws existing in country ensure rights to workers including freedom of unionization and collective bargaining, but this is o­nly in books. Practically, there is no or very few implementation of labor laws, without any freedom of association. Unfortunately approach and attitude of government authorities and employers towards workers is very unsupported, not allowing workers to practice their very legal right of trade union and collective bargaining. The union submitted a Workers Charter of Demands to Capital Industry�s� management, so encounter, the management also serve the demand notice to union demanding to reduce the wages and other facilities. Management main purpose to harass the union leaders to withdraw its Demand Notice or make the agreement according to Management wishes. This action of the management clearly violating ILO Conventions 98 and 87, Constitution of Pakistan as well as the Industrial Relation Ordinance 2002.

Brief Scenario of Workers Struggle /Challenges in Capital Industry (Pvt) Ltd.

Capital Industry (Pvt) Ltd. Manufacturing bicycles, located at Gulberg Industrial Area, Lahore, Pakistan. Employed nearly 600 workers. Capital Industry Workers Union is affiliated with All Pakistan Trade Union Federation, got success in referendum in April 2005, The management did not recognize the collective bargaining status of the union and used different tactics to harass the union leaders and workers. Union is peaceful element union tries to dialogue with the management for the acceptance of workers demand, but management does not recognize workers union, and instead of dialogue o­n demands, threatens the workers/union office bearers not to pursue the demand notice. And terminated 24 workers and six office bearers

Since the CCC's original request for action in relation to this case, there has not been substantial progress made o­n the part of the companies involved in addressing the workers demands. Therefore at this time the CCC is calling for increased action o­n this case.Since the last update, o­ne of the workers, Mr. Pragun Boomluom, was transferred back to his original post at the factory, while Ms. Mala Phosit, o­ne of the three activists who was dismissed, was forced to accept severance pay from the factory due to her desperate financial situation.

On 29 October 2004, three executives of a recently formed union at MSP Sportswear in Thailand were dismissed. Since then, the remaining nine executives in the plant have been subjected to constant harassment and have been prevented from carrying out their union activities. In the period since the dismissal there have been several meetings between the union executives, the local organization supporting them (CLIST), government officials and the main buyer, Nike. So far this has not resulted in any real progress, even though the conciliator from the Labour and Welfare department personally advised that the fired unionexecutives should be rehired. The other buyer, the French company Decathlon, has reportedly sent an audit team, but has not made direct contact with CLIST or the union.
